Terms of Service

1. Acceptance of Terms

By installing, accessing, or using the Fulfil-IT application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Fulfil-IT ("we," "us," or "our").

2. Description of Service

Fulfil-IT is a Shopify application that provides order fulfillment functionality, including:

• Order lookup and management
• SKU barcode scanning for item verification
• Courier/shipping provider configuration
• One-click order fulfillment to Shopify
• Tracking number management

The App integrates with your Shopify store through Shopify's API to access and modify order and fulfillment data.

3. Eligibility

To use Fulfil-IT, you must:

• Have a valid Shopify store account
• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the authority to bind your business to these Terms
• Comply with all applicable laws and regulations

4. Account and Access

Access to Fulfil-IT is provided through your Shopify store's admin panel. You are responsible for:

• Maintaining the security of your Shopify account credentials
• All activities that occur under your account
• Ensuring that only authorized personnel access the App
• Promptly notifying us of any unauthorized use

5. Permitted Use

You agree to use Fulfil-IT only for its intended purpose of managing order fulfillment. You may not:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems
• Use the App to transmit malware or malicious code
• Resell, sublicense, or redistribute the App
• Use automated systems to access the App beyond normal use

6. Shopify Platform

Fulfil-IT operates on the Shopify platform. Your use of Shopify is governed by Shopify's Terms of Service. We are not responsible for:

• Shopify's platform availability or performance
• Changes to Shopify's API or policies
• Any issues arising from Shopify's services

7. Data and Privacy

Your use of Fulfil-IT is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to our data practices as described in the Privacy Policy.

8. Fees and Payment

Fulfil-IT may be offered as a free service or with paid subscription plans. If applicable:

• Fees will be clearly disclosed before purchase
• Payments are processed through Shopify's billing system
• Subscriptions renew automatically unless cancelled
• Refunds are handled according to Shopify's refund policies

9. Intellectual Property

Fulfil-IT and all associated intellectual property rights are owned by us. These Terms do not grant you any ownership rights in the App. You retain ownership of your own data and content.

The Fulfil-IT name, logo, and branding are our trademarks and may not be used without our written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF DATA

We do not warrant that the App will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages arising from fulfillment errors, shipping delays, or incorrect orders
• Any damages exceeding the fees paid by you in the past 12 months

You acknowledge that you are solely responsible for verifying fulfillment accuracy and that the App is a tool to assist, not replace, your fulfillment processes.

12. Indemnification

You agree to indemnify and hold harmless Fulfil-IT and its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any disputes with your customers related to fulfillment

13. Termination

You may terminate your use of Fulfil-IT at any time by uninstalling the App from your Shopify store.

We may suspend or terminate your access to the App at any time, with or without cause, including if:

• You violate these Terms
• Your Shopify store is suspended or terminated
• We discontinue the App

Upon termination, your right to use the App ceases immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending notification through the App or email for significant changes

Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved in the appropriate courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fulfil-IT regarding the use of the App, superseding any prior agreements.
